I have a copy of the Ipswich Dock Act 1837 and the 1852 revision.
Both state there should be a 30 feet wide passage each side of the
dock and a 40 feet wide passage each side of the river beside the
dock. These laws are current but they are being ignored and blocks
of luxury flats are being built blocking these passages. How can I
as a LIP enforce this Act and stop the passages around the dock and
river being blocked?
Why would you want to?
Why is it worth the effort?
Is it not fair to say that the Ipswich Dock Act refers only to the
Docks? Is it not also fair to say the docks around which the
developers are building their apartments are no longer in use as a
working dock?
So if they're no longer a working dock, they are now nothing more
than a land-water interface.
So with that in mind, they aren't docks anymore, so the Ipswich Dock
Act would no-longer apply to them.
